KİŞİSEL VERİLERİN İŞLENMESİ HAKKINDA AYDINLATMA BİLDİRİMİ

İyigün & Oktay Avukatlık Ortaklığı tarafından işlenebilecek kişisel verileriniz, bunların işlenme amaçları, kişisel veri toplamanın hukuki sebep ve yöntemi, kişisel verilerinizin aktarılabileceği alıcı grupları ve 6698 sayılı Kişisel Verilerin Korunması Kanunu (“KVKK”) kapsamındaki haklarınızla ilgili olarak sizleri bilgilendirmek için işbu Bildirimi hazırladık. Bu Bildirim, gerçek kişilerin kişisel verilerini kapsamakta olup, İyigün & Oktay Avukatlık Ortaklığı’nın “veri işleyen” olarak hareket ettiği hallere tatbik olmamaktadır.

Türkiye’nin önde gelen hukuk bürolarından biri olarak, KVKK, 1136 sayılı Avukatlık Kanunu ve ilgili mevzuat uyarınca “veri sorumlusu” sıfatıyla işlediğimiz kişisel verilerinizin korunmasına ve avukat-müvekkil gizliliğine büyük önem veriyor, kişisel veri işleme faaliyetleri ve ilgili süreçlerimizde şeffaflık ve hesap verebilirliği ön planda tutuyoruz. Kişisel verilerinizi mevzuata uygun olarak ve aşağıda belirtilen amaçlar ve sınırlar kapsamında işlemekte ve bunlara uygun gerekli idari ve teknik tedbirleri almaya son derece özen göstermekteyiz.

ISO 27001:2013 Bilgi Güvenliği Yönetim Sistemi, ISO 22301 İş Sürekliliği Yönetim Sistemi ve ISO 9001:2015 Kalite Yönetim Sistemi sertifikasyonlarına sahip altyapımız çerçevesinde, kişisel verilerin işlenmesi süreçleri de dahil, ilgili iş süreçlerimiz mevzuata uygun olarak hazırlanmış, önceden belirlenmiş kurumsal politika ve prosedürlere uygun olarak yürütülmektedir. Kişisel verilerin işlenmesi süreçlerimiz, İyigün & Oktay Avukatlık Ortaklığı’nın kişisel verileri işlenmesi, saklanması ve imhasına ilişkin politika ve prosedürleri ile mevzuata uygun olarak ve işbu Bildirimde açıklanan şekilde gerçekleştirilmektedir.

Kişisel verileriniz, İyigün & Oktay Avukatlık Ortaklığı’ndan hizmet alınması ya da İyigün & Oktay Avukatlık Ortaklığı’na ürün/hizmet satılmasına yönelik ürün/hizmet ilişkisi ya da benzeri ilişkiler öncesinde, sırasında veya sonrasında, oluşturduğunuz ya da paylaştığınız bilgi ve belgeler ile işlemler, paydaşlar, kamuya açık kaynak ve platformlar (basın, ticaret sicili ve ticaret odası kayıtları gibi), İyigün & Oktay Avukatlık Ortaklığı’nın sizinle ve sair kanallardan yaptığı iletişim ve araştırma, toplantı, görüşme ve yazışmalar ile internet sitemiz veya sosyal medya vasıtasıyla sözlü, yazılı ve elektronik ortamlarda toplanmakta ve bu metinde açıklanan amaçlarla otomatik (kullandığımız elektronik sistem ve programlar) ve otomatik olmayan (fiziki dosya ve kayıt tutulması) yöntemlerle işlenebilmektedir.

Kişisel verileriniz, ilgili mevzuatta bu verilerin saklanması için öngörülen bir süre var ise bu süre kadar ve/veya işlendikleri amaç için gerekli olan süre boyunca Türkiye’de saklanmaktadır. İlgili sürelerin sonunda, kişisel verileriniz mevzuata ve İyigün & Oktay Avukatlık Ortaklığı’nın ilgili politika ve prosedürlerine uygun olarak silinecek, yok edilecek veya anonimleştirilecektir.

Başlıca Faaliyetlerimiz Kapsamında Kişisel Verilerin İşlenmesi

Kişisel Verilerin İşlenmesinin Hukuki Sebepleri

Kişisel verileriniz, müvekkillerimize sunduğumuz hukuki danışmanlık/avukatlık hizmet süreçlerimiz, iş geliştirme ve tedarik süreçlerimiz ile İyigün & Oktay Avukatlık Ortaklığı’nın idare ve yönetimi ile finansal operasyonları çerçevesinde aşağıda belirtilen amaçlarla gerekli olduğu ölçüde, KVKK’nın 5/2(c) maddesinde öngörülen, bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması, KVKK’nın 5/2(d) maddesi kapsamında kişisel verilerin tarafınızca alenileştirilmiş olması, KVKK’nın 5/2(e) maddesi kapsamında veri işlemenin bir hakkın tesisi, kullanılması veya korunması için zorunlu olması ya da KVKK’nın 5/2(f) maddesi gereği veri sorumlusu İyigün & Oktay Avukatlık Ortaklığı’nın meşru menfaatleri için veri işlenmesinin zorunlu olması hukuki sebepleriyle veya gereken hallerde açık rızanız çerçevesinde işlenebilmektedir.

Kişisel verileriniz ayrıca, hukuki süreçlerin yürütülmesi/karşılanması amacıyla KVKK’nın 5/2(e) maddesi gereği hakkın tesisi, kullanılması veya korunması için veri işlemenin zorunlu olması hukuki sebebiyle ve başta 1136 sayılı Avukatlık Kanunu olmak üzere yürürlükteki mevzuat kapsamındaki yükümlülüklerimizin getirilebilmesi ve yetkili mercilerin bilgi belge taleplerinin karşılanması gereklilikleri çerçevesinde KVKK’nın 5/2(ç) maddesi gereği hukuki yükümlülüklerin yerine getirilmesi veya KVKK’nın 5/2(f) maddesi gereği veri sorumlusu İyigün & Oktay Avukatlık Ortaklığı’nın meşru menfaatleri için veri işlenmesinin zorunlu olması hukuki sebepleriyle işlenebilmektedir.

Mevzuat değişiklikleri ve hukuki gelişmeler ile bülten, yayın ve etkinliklerimize yönelik bilgilendirmeler kapsamındaki kişisel veriler, hukuki danışmanlık/avukatlık ilişkisinin gerekleri ölçüsünde KVKK’nın 5/2(f) maddesi gereği veri sorumlusu İyigün & Oktay Avukatlık Ortaklığı’nın meşru menfaatleri için veri işlenmesinin zorunlu olması hukuki sebebiyle ya da hizmet, yayın ve etkinliklerimizle ilgilenen kişilerin açık rızaları çerçevesinde işlenebilmektedir.

1.Hukuki Danışmanlık ve Avukatlık Hizmetleri

Hukuki danışmanlık ve avukatlık hizmetlerimiz çerçevesinde, müvekkillerimiz, proje paydaşları, ana faaliyet alanıyla ilgili danışmanlık/destek alınan tedarikçiler, görüş temin edilen uzmanlar, ilgili danışmanlık ya da avukatlık hizmetine veya uyuşmazlığa konu ya da taraf olan kişiler ile bunların temsilci ve çalışanları ile hakim, savcı, taraf vekili, bilirkişi, noter gibi üçüncü kişiler ile ilgili veriler işlenebilmektedir.

1.1.Kişisel Verilerinizin İşlenme Amaçları

Kişisel verileriniz aşağıda belirtilen amaçlar kapsamında işlenmektedir:

• Müvekkillere hukuki danışmanlık ve avukatlık hizmetleri sunulması ile diğer sözleşmesel yükümlülüklerimizin yerine getirilmesi ve raporlanması;
• Müvekkillere sunulan hizmetler kapsamında müvekkiller, onların paydaşları ve müvekkiller adına üçüncü kişilerle yapılan iletişimler;
• Müvekkillerin mevzuat ve sair konulardaki gelişmelerden haberdar edilmesi;
• Müvekkillere sunulan hukuki danışmanlık ve avukatlık hizmetleriyle bağlantılı olarak, İyigün & Oktay Avukatlık Ortaklığı tarafından uzman, bilirkişi görüşü ve mütalaa alınması, üçüncü kişilerden ürün/hizmet tedarik edilmesi ve ilgili süreçlerin yürütülmesi;
• Serbest meslek makbuzu düzenlenmesi, ödeme, muhasebe ve mutabakat süreçlerinin yürütülmesi;
• Kurumsal iletişim süreçlerimizin yürütülmesi ve müvekkil ilişkilerinin ve iletişiminin güçlendirilmesi;
• İyigün & Oktay Avukatlık Ortaklığı tarafından düzenlenen ya da İyigün & Oktay Avukatlık Ortaklığı’nın katıldığı/parçası olduğu etkinliklerin organizasyonu ve duyurulması;
• Finans, BT, İK, ofis yönetimi, sekreterya, muhaberat, arşiv vb. iç süreçlerin yürütülmesi
• Varlıklarımızın ve bilgi güvenliğinin sağlanması;
• Kurumsal yapının yönetimi ve idaresi, İyigün & Oktay Avukatlık Ortaklığı içi raporlama faaliyetlerinin icrası ile denetim, iş geliştirme vb. çalışmaların yürütülmesi, sözleşme yönetimi, hukuk ve muhasebe süreçleri ile İyigün & Oktay Avukatlık Ortaklığı‘nın dahili kural ve politikalarının yerine getirilebilmesi;
• İlgili mevzuat uyarınca gelebilecek talepler doğrultusunda gerekli bilgi ve belgelerin icra daireleri ve kolluk kuvvetleri dahil olmak üzere adli ve idari mercilere sunulması;
• 1136 sayılı Avukatlık Kanunu başta olmak üzere, İyigün & Oktay Avukatlık Ortaklığı’nın mevzuat kapsamındaki yükümlülüklerinin yerine getirilmesi.

1.2. Kişisel Verilerinizin Aktarımı

İyigün & Oktay Avukatlık Ortaklığı’nın standart süreçleri çerçevesinde, kişisel verilerinizin yukarıda belirtilen amaçlarla ve mevzuata uygun olarak, söz konusu amaçlar için gerekli ve ilgili olduğu ölçüde üçüncü kişilerle paylaşılabileceği başlıca durumlar aşağıdaki gibidir:

Kişisel verileriniz, hukuki danışmanlık ve avukatlık hizmetlerimizin sunulması için gerekli hallerde müvekkiller, ilgili proje paydaşları, görüş temin edilen uzmanlar ve danışmanlar, mahkemeler, noterler ve ilgili kurum ve kuruluşlar gibi üçüncü kişiler ile; ödemelerin gerçekleştirilmesi için bankalar ile; etkinlik organizasyonları için organizasyon şirketi, etkinlik mekanı vb. kişiler ile; BT, İK, finans, muhasebe, denetim, tasarım, kargo, toplu ileti gönderimi vb. alanlarda hizmet aldığımız tedarikçi ve danışmanlarımız ile; hukuki yükümlülüklerimiz veya mevzuat çerçevesinde bilgilerinizi talep etme yetkisine sahip mercilerden gelebilecek talepler kapsamında ya da uyuşmazlıklar halinde yetkili mercilerle paylaşılabilecektir.

2. İş Geliştirme ve Bülten Yayınları

Hukuki danışmanlık ve avukatlık hizmetleri sunduğumuz müvekkillerimiz, proje paydaşları, ana faaliyet alanıyla ilgili danışmanlık/destek alınan tedarikçiler, görüş temin edilen uzmanlar ile bunların temsilci ve çalışanları ile hizmet ve yayınlarımızla ilgilenen kişiler ile ilgili veriler işlenebilmektedir.

2.1. Kişisel Verilerinizin İşlenme Amaçları

Kişisel Verileriniz aşağıda belirtilen amaçlar kapsamında işlenmektedir:

• Müvekkillere sunulan hukuki danışmanlık ve avukatlık hizmetleri ile diğer sözleşmesel yükümlülüklerimizin yerine getirilmesi ve raporlanması;
• İş geliştirme süreçlerinin yürütülmesi ve hizmetlerimizin iyileştirilmesi;
• Kurumsal iletişim süreçlerimizin yürütülmesi ve müvekkil ilişkileri ile iletişiminin güçlendirilmesi;
• Bülten, Hukukta Gündem, makale, hukuk alanındaki gelişmeler vb. yayın ve çalışmalarımızın posta ve e-posta gibi yollarla mevcut ve potansiyel müvekkillerimiz ile yayın ve çalışmalarımızla ilgilenen diğer kişiler ile paylaşılması;
• İyigün & Oktay Avukatlık Ortaklığı tarafından düzenlenen ya da İyigün & Oktay Avukatlık Ortaklığı’nın katıldığı/parçası olduğu etkinliklerin organizasyonu ve duyurulması;
• Finans, BT, İK, ofis yönetimi, sekreterya, muhaberat, arşiv vb. iç süreçlerin yürütülmesi;
• Varlıklarımızın ve bilgi güvenliğinin sağlanması;
• Kurumsal yapının yönetimi ve idaresi, İyigün & Oktay Avukatlık Ortaklığı içi raporlama faaliyetlerinin icrası ile denetim, iş geliştirme vb. çalışmaların yürütülmesi, sözleşme yönetimi, hukuk ve muhasebe süreçleri ile İyigün & Oktay Avukatlık Ortaklığı’nın dahili kural ve politikalarının yerine getirilebilmesi;
• İlgili mevzuat uyarınca gelebilecek talepler doğrultusunda gerekli bilgi ve belgelerin icra daireleri ve kolluk kuvvetleri dahil olmak üzere adli ve idari mercilere sunulması;
• 1136 sayılı Avukatlık Kanunu başta olmak üzere, İyigün & Oktay Avukatlık Ortaklığı’nın mevzuat kapsamındaki yükümlülüklerinin yerine getirilmesi.

2.2.Kişisel Verilerinizin Aktarımı

İyigün & Oktay Avukatlık Ortaklığı’nın standart süreçleri çerçevesinde, kişisel verilerinizin yukarıda belirtilen amaçlarla ve mevzuata uygun olarak, söz konusu amaçlar için gerekli ve ilgili olduğu ölçüde üçüncü kişilerle paylaşılabileceği başlıca durumlar aşağıdaki gibidir:

Kişisel verileriniz, etkinlik organizasyonları için organizasyon şirketi, etkinlik mekanı vb. kişiler ile; iş geliştirme süreçleri çerçevesinde müvekkil referans kişilerinin onayı halinde yurtiçi ve yurtdışındaki mesleki deneyim bilgilerini derleyen platformlar ile; BT, İK, finans, muhasebe, denetim, tasarım, kargo, toplu ileti gönderimi vb. alanlarda hizmet aldığımız tedarikçi ve danışmanlarımız ile; hukuki yükümlülüklerimiz veya mevzuat çerçevesinde bilgilerinizi talep etme yetkisine sahip mercilerden gelebilecek talepler kapsamında ve uyuşmazlıklar halinde yetkili mercilerle paylaşılabilecektir.

3. Ana Faaliyet Alanı Dışındaki Mal/Hizmet Tedarik Süreçleri

İyigün & Oktay Avukatlık Ortaklığı’nın ana faaliyet alanı dışındaki mal/hizmet tedarik süreçlerinde, danışmanlık/destek alınan tedarikçiler, kira, satın alma ve benzeri ilişki kurulan üçüncü kişiler ile bunların temsilci ve çalışanları ile ilgili veriler işlenebilmektedir.

3.1. Kişisel Verilerinizin İşlenme Amaçları

Kişisel verileriniz aşağıda belirtilen amaçlar kapsamında işlenmektedir:

• Ofisimiz ihtiyaçlarının karşılanması için gerekli ürün/hizmet tedarik ve satın alma süreçlerinin yürütülmesi ile ürün/hizmet ilişkisi çerçevesinde sözleşmesel yükümlülüklerimizin yerine getirilmesi ve gerekli iletişimin sağlanması;
• Faturalandırma, ödeme, muhasebe ve mutabakat süreçlerinin yürütülmesi;
• Finans, BT, İK, ofis yönetimi, sekreterya, muhaberat, arşiv vb. iç süreçlerin yürütülmesi;
• Varlıklarımızın ve bilgi güvenliğinin sağlanması;
• Kurumsal yapının yönetimi ve idaresi, İyigün & Oktay Avukatlık Ortaklığı içi raporlama faaliyetlerinin icrası ile denetim, iş geliştirme vb. çalışmaların yürütülmesi, sözleşme yönetimi, hukuk ve muhasebe süreçleri ile İyigün & Oktay Avukatlık Ortaklığı’nın dahili kural ve politikalarının yerine getirilebilmesi;
• İlgili mevzuat uyarınca gelebilecek talepler doğrultusunda gerekli bilgi ve belgelerin icra daireleri ve kolluk kuvvetleri dahil olmak üzere adli ve idari mercilere sunulması;
• 1136 sayılı Avukatlık Kanunu başta olmak üzere, İyigün & Oktay Avukatlık Ortaklığı’nın mevzuat kapsamındaki yükümlülüklerinin yerine getirilmesi.

3.2. Kişisel Verilerinizin Aktarımı

İyigün & Oktay Avukatlık Ortaklığı’nın standart süreçleri çerçevesinde, kişisel verilerinizin yukarıda belirtilen amaçlarla ve mevzuata uygun olarak, söz konusu amaçlar için gerekli ve ilgili olduğu ölçüde üçüncü kişilerle paylaşılabileceği başlıca durumlar aşağıdaki gibidir:

Kişisel verileriniz, İyigün & Oktay Avukatlık Ortaklığı ile mal veya hizmet tedariki ya da ilgili ilişkiniz çerçevesinde ödemelerin gerçekleştirilmesi için bankalar ile; gerekli olduğu ölçüde hizmet aldığımız diğer tedarikçiler ile; müvekkillerimize sunduğumuz hizmetler çerçevesinde gerekli hallerde müvekkillerimiz ve ilgili kurum ve kuruluşlar gibi üçüncü kişiler ile ve mevzuat çerçevesinde bilgilerinizi talep etme yetkisine sahip mercilerden gelebilecek talepler kapsamında ve uyuşmazlıklar halinde yetkili mercilerle paylaşılabilecektir.

4. İnternet Sitesi Kullanımı

https://www.iyigun-oktaypartners.com adresindeki internet sitemizi ziyaret eden kişilerin internet sitemizi etkin bir şekilde kullanabilmesi için geçici süreyle saklanan gerekli çerezler kullanılabilmektedir. İlgili çerezler oturumun sona ermesi üzerine otomatik olarak silinmektedir.

Kişisel verileriniz hizmet aldığımız tedarikçiler ile ve mevzuat çerçevesinde bilgilerinizi talep etme yetkisine sahip mercilerden gelebilecek talepler kapsamında ve uyuşmazlıklar halinde yetkili mercilerle paylaşılabilecektir.

Diğer Faaliyetlerimiz Kapsamında Kişisel Verilerin İşlenmesi

Kişisel verilerinizin, yukarıda belirtilen temel faaliyetler haricinde arızi olarak yürütülen süreçler kapsamında işlenmesi gerekmesi halinde, ilgili işleme süreçleri, her halükârda KVKK’nın 5 ve 6. maddelerinde belirtilen aşağıda sayılı hukuki sebeplere veya açık rızanıza dayanılarak, ilgili mevzuata ve İyigün & Oktay Avukatlık Ortaklığı’nın ilgili politika ve prosedürlerine uygun olarak gerçekleştirilecektir:

1. Açık rızanız;
   b. Kanunlarda açıkça öngörülmesi;
   c. Fiili imkânsızlık nedeniyle rızasını açıklayamayacak durumda bulunan veya rızasına hukuki geçerlilik tanınmayan kişinin kendisinin ya da bir başkasının hayatı veya beden bütünlüğünün korunması için zorunlu olması;
   ç. Bir sözleşmenin kurulması veya ifasıyla doğrudan doğruya ilgili olması kaydıyla, sözleşmenin taraflarına ait kişisel verilerin işlenmesinin gerekli olması;
   d. İyigün & Oktay Avukatlık Ortaklığı’nın hukuki yükümlülüğünü yerine getirebilmesi için zorunlu olması;
   e. Kişisel verilerin tarafınızca alenileştirilmiş olması;
   f. Bir hakkın tesisi, kullanılması veya korunması için veri işlemenin zorunlu olması;
   g. Temel hak ve özgürlüklerinize zarar vermemek kaydıyla, İyigün & Oktay Avukatlık Ortaklığı’nın meşru menfaatleri için veri işlenmesinin zorunlu olması.

Haklarınız ve İletişim

KVKK çerçevesinde aşağıdaki haklara sahip olduğunuzu hatırlatmak isteriz:

1. Kişisel verilerinizin işlenip işlenmediğini öğrenme ve buna ilişkin bilgi talep etme;
   b. Kişisel verilerin işlenme amacını ve bunların amacına uygun kullanılıp kullanılmadığını öğrenme;
   c. Yurtiçinde veya yurtdışında kişisel verilerinizin aktarıldığı üçüncü kişileri bilme;
   ç. Kişisel verilerinizin eksik veya yanlış işlenmiş olması halinde bunların düzeltilmesini isteme, KVKK mevzuatında öngörülen şartlar çerçevesinde kişisel verilerinizin silinmesini veya yok edilmesini isteme ve bu hallerde yapılan işlemlerin kişisel verilerinizin aktarıldığı üçüncü kişilere bildirilmesini isteme;
   d. İşlenen verilerin münhasıran otomatik sistemler vasıtasıyla analiz edilmesi suretiyle aleyhinize bir sonucun ortaya çıkmasına itiraz etme;
   e. Kişisel verilerin kanuna aykırı olarak işlenmesi sebebiyle zarara uğramanız halinde bu zararın giderilmesini talep etme.

Kişisel verilerinizle ilgili herhangi bir sorunuz ya da talebiniz olması halinde, “Mutlukent Mahallesi, 2012. Cadde Beyköy Sitesi 2/19 Çankaya/Ankara” adresine ya da (bize önceden bildirdiğiniz ve kayıtlarımızda yer alan e-posta adresiniz üzerinden) info@iyigun-oktaypartners.com adresine yazılı olarak başvurabilirsiniz. Başvurunuza sağlıklı yanıt verilebilmesi için talebinizin belirli, açık ve anlaşılır olması, talep ettiğiniz konunun şahsınız ile ilgili olması veya başkası adına hareket ediyor iseniz bu konuda özel olarak yetkili olmanız ve yetkinizin belgelendirilmesi, ayrıca mevzuat gereğince başvurunuzun ad, soyad, TCKN (yabancılar için uyruk ve pasaport numarası), cevabımızı iletebileceğimiz adres bilgilerini ve kimliğinizi tevsik edici belgeleri içermesi gerekmektedir.

We, İyigün & Oktay Attorney Partnership, have prepared this Privacy Notice to inform you regarding your personal data that may be processed by İyigün & Oktay Attorney Partnership, and regarding the purposes of processing, methods and legal grounds for collection, categories of recipients to whom the personal data may be transferred, and your rights under the Law on the Protection of Personal Data numbered 6698 (“LPPD”). This Privacy Notice applies to personal data of individuals and shall not apply in cases where İyigün & Oktay Attorney Partnership acts as the “data processor”.

As one of the leading law firms in Turkey, we attribute great importance to protecting the personal data that we process in a “data controller” capacity within the framework of applicable legislation, including the LPPD, the Attorneyship Law numbered 1136, as well as to the confidentiality between attorneys and clients.  We prioritize transparency and accountability with respect to data processing activities and processes. We process your personal data in accordance with the relevant legislation, only for the purposes and limitations defined below, and take the utmost care to implement the necessary and appropriate technical and organizational measures.

Your personal data may be collected through the information and documents that you have produced or shared with us prior to, during, or after receiving services from İyigün & Oktay Attorney Partnership or selling goods/services to İyigün & Oktay Attorney Partnership or through other similar relations, transactions, stakeholders, publicly available resources and platforms (such as media records, the trade registry, and the chamber of commerce); communications, research, meetings, interviews, and correspondences that İyigün & Oktay Attorney Partnership has made with you and through other channels, including our website and social media, via oral, written, and electronic platforms, and are processed through automatic (electronic systems and programs that we use) and non-automatic (physical files and physical record keeping activities) means for the purposes explained in this Privacy Notice.
